What Evidence Do You Need for Small Claims Court?

Evidence is the backbone of any small claims case. The type of evidence you need depends on your specific dispute, but here's a comprehensive guide to what works best:

Written contracts and agreements. Any written contract — even an informal email agreement — is powerful evidence. If you made a verbal agreement, document everything you remember about it in writing as soon as possible.

Receipts and invoices. Keep every receipt, invoice, and payment record related to your dispute. Bank and credit card statements showing payments made are also useful.

Photos and videos. Visual evidence is highly persuasive. If you're claiming property damage, document it extensively with timestamped photos. Before-and-after photos are particularly compelling.

Communications. Save all text messages, emails, and voicemails. Print them out and organize them chronologically. If the other party made admissions or promises in writing, highlight those.

Witness testimony. Bring any witnesses to court in person. Their live testimony carries more weight than written statements, though written statements notarized by a witness can help if in-person attendance isn't possible.

Estimates and repair bills. If you're seeking damages for property repair, get written estimates from at least two contractors. Paid repair bills are even better.

Expert opinions. For technical disputes (construction defects, medical issues, car damage), a written opinion from a relevant professional can support your case.

What NOT to bring: Social media screenshots without proper authentication can be challenged. Hearsay (someone told you that someone else said something) is generally not admissible. Keep your evidence focused and relevant.
