How to Win in Small Claims Court

Winning in small claims court comes down to preparation, evidence, and presentation. Judges see dozens of cases per day — the ones who win are typically the ones who come most prepared.

Have solid evidence. This is the single biggest factor. Bring contracts, receipts, photos, text messages, emails, bank statements, and any other documentation that supports your claim. Organize everything in a folder or binder with copies for the judge and the other party.

Send a demand letter first. Even if your state doesn't require it, having proof that you tried to resolve the dispute before filing shows good faith and often impresses judges.

Know your legal basis. Understand why you're entitled to what you're asking for. Is it breach of contract? Negligence? Fraud? You don't need to cite specific laws, but you should be able to explain the legal theory behind your claim in plain language.

Bring witnesses. If anyone witnessed the events in question, bring them to testify in person. Written statements from witnesses carry less weight than live testimony in most small claims courts.

Practice your presentation. You'll have limited time — typically 10-15 minutes. Practice explaining your case clearly and concisely. Focus on facts, not emotions. Stay calm even if the other party says things that aren't true.

Arrive early and be professional. Dress conservatively, address the judge as 'Your Honor,' and never interrupt the other party when they're speaking. Judges notice demeanor.

Know what you're asking for. Calculate your damages precisely. Vague requests like 'I want to be compensated' are less effective than 'I am requesting $4,750 in damages, which represents the $3,000 repair cost plus $1,750 I paid for the original work that was never completed.'
